Privacy Policy

This Privacy Policy explains how Fewbits Inc. ("Agnify", "we") collects, uses, and shares information when you visit our website, create an account, or use the Agnify video-analytics service (the "Service"). It applies to information we collect about you when you interact with us directly.

When you use the Service to process video, images, or other media containing personal information about other individuals (Customer Content), you direct the processing — your own privacy policies, notices, and consents govern that processing, and you remain responsible for the lawful basis for it. We process Customer Content on your behalf as described in the Terms of Service.

Capitalized terms used but not defined here have the meanings in our Terms of Service.

You upload videos, images, camera streams, and other media to the Service. Outputs we generate from that media (detections, masks, tracks, attributes, rendered video, exports) are also Customer Content. This Customer Content may include personal information about individuals appearing in the media — including faces, voices, license plates, and other identifiers.

Customer Content may contain biometric identifiers or biometric information as defined under U.S. state biometric privacy laws (including the Illinois Biometric Information Privacy Act, "BIPA"). We process Customer Content as directed by you to provide and improve the Service (see Section 2.1), subject to the retention practices described in Section 4. We do not sell, lease, trade, or otherwise profit from biometric content. You are responsible for obtaining any required notices, consents, and permissions from individuals appearing in Customer Content, and you may not submit Customer Content containing biometric information unless you have obtained all consents and provided all notices required by applicable law.

You are responsible for the lawfulness of Customer Content, including obtaining any consents (including any written consents required by BIPA or similar laws) and providing any notices required for individuals appearing in it. See the Terms of Service for your representations.

2.1 Use of Customer Content for Service Improvement

Unless your account is covered by a separate enterprise agreement that says otherwise, we may use Customer Content and outputs to provide, maintain, protect, evaluate, optimize, improve, and develop the Service. Enterprise Customer Content is used as described in the applicable enterprise agreement or order form. See Terms of Service §3.3.

We do use Service Data (data about how the Service is used, distinct from Customer Content — see Terms of Service §3.4) to operate, debug, evaluate, and improve the Service, including to measure model and pipeline performance. Service Data does not include the underlying images or video.

We retain information for as long as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods depend on the type of information and the purpose for which it is held; account and billing records are typically retained for the life of the Account and a reasonable period thereafter.

When you delete Customer Content or close your Account, we will delete or de-identify the associated Customer Content from our active systems within a commercially reasonable period (generally within 30 days), subject to:

We use administrative, technical, and physical safeguards designed to protect information against loss, theft, unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure. You are responsible for keeping your credentials confidential and for the activities under your Account.

We use first-party cookies and similar technologies for authentication, security, preferences, and analytics. Where required by law, we will request your consent before placing non-essential cookies. You can control cookies through your browser settings; disabling cookies may affect Service functionality.

We do not use third-party advertising cookies and do not allow third parties to use the Service to track you for cross-context behavioral advertising.

7. Your Rights

Depending on where you live, you may have rights with respect to your personal information, including:

You can exercise these rights by contacting us at privacy@agnify.ai. We will respond within the period required by applicable law. We may need to verify your identity before fulfilling certain requests. If you are exercising a right with respect to information that another customer uploaded to the Service (as Customer Content about you), we will refer your request to that customer, who is the controller of that information; we will assist them in responding as required by our agreements with them.

7.1 California residents

California residents may exercise the rights described above with respect to personal information we collect as a business under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA"). We do not sell personal information and do not share personal information for cross-context behavioral advertising, as those terms are defined under California law. You may also designate an authorized agent to act on your behalf.

Categories of personal information we collect. In the 12 months preceding the "Last Updated" date of this Policy, we have collected the following CCPA categories of personal information: (i) identifiers (name, email, account ID, IP address); (ii) commercial information (transaction history, billing); (iii) internet or other electronic network activity (interaction with the Service, log data); (iv) geolocation (approximate, derived from IP); (v) audio, electronic, visual, or similar information (Customer Content you upload); (vi) professional or employment information (role and organization name, where provided); and (vii) inferences drawn from the above (aggregated usage patterns). We collect these for the business and commercial purposes described in Section 2.

Sensitive personal information. Customer Content may contain biometric information (a category of sensitive personal information under the CCPA). We use such information only as described in Sections 1.2 and 2.1. You may contact us at privacy@agnify.ai to request that we limit our use of any sensitive personal information you have submitted.

Do Not Track. Our website does not respond to "Do Not Track" browser signals.

7.2 European Economic Area, United Kingdom, and Switzerland

We do not currently offer a self-serve Data Processing Addendum, Standard Contractual Clauses, UK Addendum, or similar data-processing terms for the beta Service. If your use of the Service requires those terms, contact privacy@agnify.ai before submitting Customer Content. On request, we will provide our then-current data processing terms so that you can assess whether your processing through the Service meets your obligations.

Where the Service is used to process personal information about EEA, UK, or Swiss residents, our legal basis is generally either (i) contract — where processing is necessary to provide the Service requested by you, (ii) legitimate interests — where processing is necessary to operate, secure, and improve the Service in a manner that does not override the rights of data subjects, or (iii) consent — where required. You have the right to lodge a complaint with your local data protection authority.

8. International Transfers

We are based in the United States. When we process personal information, we may transfer it to, and store and process it in, the United States or other countries where we or our service providers operate. Those countries may have data protection laws different from your country. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers.

9. Children

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided personal information to us, contact privacy@agnify.ai and we will take steps to delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last Updated" date and, for material changes, take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance.
