Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs your use of the Agnify video-analytics service (the "Service") provided by Fewbits Inc. ("Agnify", "we"). The AUP is part of our Terms of Service. Capitalized terms used but not defined here have the meanings in the Terms of Service.

You are responsible for your use of the Service and for your users' use of the Service, including all Customer Content you upload, stream, or process. By using the Service, you agree to the AUP.


1. Prohibited Uses

You may not use the Service, and you may not allow anyone else to use the Service, to:

  1. Illegal surveillance or processing of non-consenting persons. Surveil, monitor, identify, profile, or process media of individuals where the surveillance or processing violates applicable law in the jurisdiction where the individuals are located, or where required consent has not been obtained.

  2. Unlawful workplace monitoring. Monitor employees or others in workplaces without providing the notices, obtaining the consents, or following the procedures required by applicable law (including notice requirements in some U.S. states and EU Member States).

  3. Biometric identification without consent. Use the Service to identify, recognize, or verify the identity of individuals from biometric identifiers (including facial images) without first obtaining all consents and providing all notices required by applicable law (including the Illinois Biometric Information Privacy Act ("BIPA") and similar statutes in Texas, Washington, and other jurisdictions).

  4. Non-consensual synthetic media. Generate, produce, or modify media depicting an identifiable person in a way that falsely presents them as having said or done something they did not, without that person's consent (including "deepfakes" and non-consensual face-swap content).

  5. Content involving minors. Process video or images of minors without the consent of a parent or legal guardian, or in a manner inconsistent with applicable child-protection laws. Process, host, transmit, or generate any child sexual abuse material ("CSAM") — accounts found to have done so will be terminated immediately, and we will report to the National Center for Missing and Exploited Children and to law enforcement as required.

  6. Violence and prohibited content. Process or generate content depicting violence against persons in a way intended to incite violence or harassment, or any content prohibited by applicable law.

  7. Reverse engineering and scraping. Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying ideas or algorithms from the Service, except to the extent that limitation is prohibited by applicable law. Scrape, crawl, or harvest data from the Service through automated means other than the documented APIs you are authorized to use. (Programmatic access to your own data via the documented APIs is permitted.)

  8. Unauthorized access or security testing. Attempt to gain unauthorized access to the Service, to any account, or to any system or network connected to the Service. Conduct penetration testing, vulnerability scanning, or other security probing of the Service without our prior written authorization. To request authorization, contact security@agnify.ai. Good-faith security research conducted consistent with our security disclosure policy (when published) is authorized; until that policy is published, contact security@agnify.ai to coordinate before testing.

4. High-Stakes Decisions

The Service produces machine-learning outputs that are probabilistic and may be incorrect. You may not use Service outputs as the sole basis for any consequential decision affecting an individual — including decisions about employment, education, credit, housing, insurance, healthcare, public benefits, criminal justice, or immigration — without independent human review and an opportunity for the affected individual to contest the decision. You are responsible for any such decision and for any required adverse-action notices.

5. Reporting Violations

If you become aware of a violation of this AUP — including CSAM, security vulnerabilities, or unlawful use of the Service — report it to abuse@agnify.ai (general abuse) or security@agnify.ai (security). For CSAM specifically, report directly to the National Center for Missing and Exploited Children (report.cybertip.org) and notify us at abuse@agnify.ai.

6. Enforcement

We have no obligation to monitor Customer Content or user activity, but we may review or investigate suspected violations of this AUP. We may take any of the following actions:

For violations that are not illegal and do not pose a safety or security risk, we will use commercially reasonable efforts to notify you and provide an opportunity to remediate before suspending or terminating access. We reserve the right to act immediately, with or without prior notice, when, in our reasonable judgment, the violation involves illegal conduct, threats to safety, threats to the integrity or security of the Service, threats to other users or their data, or material legal or reputational risk to Agnify.

7. Changes

We may update this AUP from time to time. We will post the updated version with a new "Last Updated" date and, for material changes, take reasonable steps to notify you.
